Terms of Use
These terms are an agreement between you and Andrei Micuda, Romania ("we", "us"), who runs TopOut. By creating an account or using the app, you agree to them. Our Privacy Policy explains how we handle your data.
1. Who can use TopOut
You must be at least 16 years old. You sign in with Google (or Apple, on iOS). Keep your account to yourself; you are responsible for what is posted from it.
2. TopOut is in beta
TopOut is an early version. Features may change or break, and data may occasionally be lost. Please tell us when something goes wrong.
3. Climbing is your responsibility
Bouldering is dangerous. Grades, Route photos, Beta videos, ratings and gym information on TopOut come from other climbers, gyms and Google, and may be wrong or out of date. They are no substitute for your own judgement or your gym's rules. Follow your gym's safety rules and climb within your ability.
4. Your content
You keep ownership of the photos, videos, comments and other content you post. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, resize, re-encode and display it in TopOut, for as long as it is on TopOut. Content you post is public: anyone using TopOut can see it.
Only post content you have the right to post. Do not film or photograph other people in a way they would object to, and respect your gym's rules on filming.
5. Zero tolerance for objectionable content and abuse
TopOut has no tolerance for objectionable content or abusive users. Do not post or do any of the following:
- harassment, bullying, threats or hate speech toward anyone;
- sexual or sexually suggestive content, nudity, or graphic violence;
- content that endangers or exploits minors;
- spam, advertising, scams, or misleading information on purpose (for example false grades or fake Routes);
- someone else's personal information, or content that infringes someone's copyright or other rights;
- impersonating another person, gym or organisation;
- anything illegal, or that encourages dangerous or illegal behaviour;
- attempts to break, overload, scrape or get unauthorised access to TopOut.
6. Reporting and moderation
You can report a Route, a Beta video or a climber's Profile from the app using Report, or email [email protected]. We review every report within 24 hours. Content that breaks these terms is removed, and the account that posted it may be suspended or permanently banned. We may also remove content or suspend accounts without a report when we find a breach.
Gym admins may retire or edit Routes at their gym, and we may edit or remove gym information that is wrong.
7. Ending your account
You can delete your account at any time: in the app, open your Profile, then Account › Delete account, or email [email protected]. Your account and personal data are deleted within 7 days, as described in the Privacy Policy. We may suspend or close accounts that break these terms.
8. Our app
TopOut, its name, logo and design belong to us. You may use the app for your own, non-commercial climbing. Gym names, addresses and hours are provided by Google Places.
9. No warranty; limits on our liability
TopOut is free and provided "as is", without warranties of any kind. To the extent the law allows, we are not liable for any injury, loss or damage arising from climbing, from content posted by others, or from the app being unavailable or losing data. Nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by our negligence, fraud, or your rights as a consumer.
10. Changes
We may update these terms. If a change matters, we will update the date above and tell you in the app before it applies. If you keep using TopOut after that, the new terms apply.
11. Law
These terms are governed by the laws of Romania. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in its courts.
